Terms of Service | ImprovApp

These Terms of Service ("Terms") govern your use of ImprovApp, operated by Random Social LLC ("we," "us," or "our"). By using ImprovApp, you agree to these Terms.

1. Service Description

ImprovApp is a real-time group game platform. Hosts create sessions, share a QR code or room code, and players join on their phones. We provide built-in game types, content packs, and tools for running interactive group activities.

2. Accounts

You can try ImprovApp without an account. If you create one, you're responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@randomsocial.com if you suspect unauthorized access.

3. Subscription Tiers and Billing

ImprovApp offers two tiers:

Free: 1 session per month, up to 20 players, all built-in game types and content packs
Host Plan ($9/month): Unlimited sessions, up to 50 players, custom content packs, custom branding, analytics

Paid subscriptions are billed through Stripe. You authorize us to charge your payment method on a recurring basis. Cancel anytime through your account settings -- access continues until the end of your billing period. Refunds are handled on a case-by-case basis.

4. Acceptable Use

You agree not to:

Create sessions or content that is illegal, defamatory, or harassing
Use the service for spam or unsolicited messaging
Attempt to circumvent usage limits or security measures
Interfere with service operation or other users' sessions
Reverse engineer or scrape the platform

We may suspend or terminate accounts violating these terms without notice.

5. Content Ownership

You retain ownership of any custom content packs and session data you create. By using ImprovApp, you grant us a license to store, display, and process your content as necessary to provide the service. We won't sell your content to third parties or use it for purposes unrelated to operating ImprovApp.

6. Intellectual Property

ImprovApp, including its design, features, game types, and branding, is owned by Random Social LLC.

7. Service Availability

We strive for high availability but don't guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice when possible. We're not liable for any loss resulting from service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Random Social LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of ImprovApp. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify Random Social LLC against claims arising from your use of the service, your content, or your violation of these Terms.

10. Termination

You may close your account at any time. We may terminate or suspend your account for Terms violations or other reasons at our discretion. Upon termination, your right to use the service ends immediately. We may delete your data after a reasonable retention period.

11. Dispute Resolution

These Terms are governed by the laws of the State of Wyoming. Any disputes will be resolved through binding arbitration, except that either party may seek injunctive relief in court. You waive any right to participate in class actions.

12. Changes to Terms

We may update these Terms periodically. We'll notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.
